Our firm typically works with the commercial real estate developer on the:

  1. CPOA formation
  2. CC&R drafting
  3. Initial budget creation, then
  4. Effecting a smooth transition to an owner controlled board/association, which is professionally managed by Mar West Real Estate.

Mar West Real Estate also takes over management of existing/mature Commercial Property Owners Associations on a regular basis.

Real Estate Association Management

  • Reviewing site, landscape, association and other project related plans
  • Providing operational input on By-Laws and CC&R's for maximum efficiency and cost containment
  • Interviewing and bidding appropriate vendors and verification of licensing and insurance
  • Bidding appropriate insurance policy costs and binding policies
  • Creating operating budgets and reserve estimates
  • All association assessment invoicing
  • All association bookkeeping, accounting, collections
  • All association financial reporting (Budget vs Actual Variance Analysis, Profit and Loss Statement, General Ledger / Check Register, Bank Statements and Reconciliations, Aged Delinquencies / Receivables).
  • All association banking
  • Establishing/changing signatories on the operating and reserve bank accounts
  • Creating and sending assessments to the owners
  • Tracking and payment of association related property taxes
  • Financial reporting as per the CC&R's and/or as mutually determined (usually quarterly)
  • Coordination of annual tax return preparation, filing and tax payments (including the coordination for filing back tax returns if necessary)
  • Advise the Board as to state laws and compliance matters
  • Enforcing the associations CC&R's
  • Communicating throughout the year with association Members and scheduling, leading and documenting the annual and any special Member meetings

  • Assisting/advising on the appointment of a Board of Directors and appointment of officers for "headless" associations
  • Assisting in the amendment of the governing documents when necessary
  • Physically inspect the property at least once per month
